Hello
I have a question about copyright. Are the data contained in graphs in
published papers copyright? Scanning/photocopying and reusing figures from
copyrighted journal articles are clearly subject to copyright restrictions.
However, what if the figure is scanned, the 'raw' data extracted (i.e. the
set of x-y co-ordinates), and these data points are used to create a 'new'
figure. Any thoughts or suggestions? A citation to the original source of
the data would be included of course.
NOTE:
The Copyright Office cannot register claims to exclusive rights in brief
combinations of words, such as:
....
-- Mere listings of ingredients, as in recipes, labels, or
formulas. (When a recipe or formula is accompanied by
explanation or directions, there may be a basis for
copyright protection.)

We all use numbers from tables, e.g. log tables, PK parameter values,
physical constants, etc. These numbers don't 'appear' to be copyright. The
formatted listing may be but not the numbers themselves - is this true??
Recently noted in a textbook - redrawn figures with the notation on many
'Modified from ....' with no explicit mention of 'with permission'. Other
notations in the same textbook included the same 'Modified from .... with
permission'.
Any thoughts or suggestions? Thanks.

Well, if you add value to public data, you can copyright the value-added
product. For example, the contents of the white pages are public data,
however, the addition of an index would make it copyrightable.
Are the data public? Can you copyright the information, even though

eplicate your experimental design and duplicate the results? I don't know
- I am just tossing out a question.
This is an area that copyright / patent / trademark issues need to expand
into. We need to remember that these systems were intended to promote
innovation by trading details of the item in exchange for a period of
exclusive use.
